Please read these Terms carefully. By creating a Coded account or using the Coded platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use Coded.
These Terms of Service ("Terms") are a legally binding agreement between you and Coded ("Coded," "we," "us," or "our") governing your access to and use of the Coded mobile application, website, and related services (collectively, the "Services").
By accessing or using the Services, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your country), that you have read and understood these Terms, and that you agree to be bound by them. If you are using Coded on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms incorporate our Privacy Policy, which describes how we collect and use your data.
To access most features of Coded, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:
We are not liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your credentials.
Each person may register one account. Creating multiple accounts to circumvent restrictions, abuse free trials, or manipulate the platform is prohibited and may result in permanent termination.
Coded offers a free tier with limited access to curriculum, AI hints, and features. No credit card is required to use the free tier.
Coded Pro is a recurring subscription billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
If you activate a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period — you retain access to Pro features until then. We do not provide prorated refunds for partial billing periods.
All charges are generally non-refundable. However, we will review refund requests made within 7 days of a charge on a case-by-case basis. Contact billing@coded.app with your request.
Payment is processed by a PCI-compliant third-party provider. Coded does not store your full payment card details.
You agree to use Coded only for lawful purposes and in accordance with these Terms. You must not:
AI coaching features are intended to support your personal learning. Systematic abuse of AI features (e.g., using AI to complete assignments for others, generating bulk content for commercial sale) is prohibited and may result in account suspension.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
The Coded platform, including all curriculum content, lesson materials, AI models, branding, design, software, and documentation, is owned by or licensed to Coded and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial learning purposes, subject to these Terms.
You may not:
If you provide us with suggestions, ideas, or feedback about the Services ("Feedback"), you grant Coded a worldwide, royalty-free, perpetual, irrevocable license to use, incorporate, and commercialize that Feedback without restriction or compensation to you.
When you submit code, comments, forum posts, or other content ("User Content") through Coded, you retain ownership of your User Content.
By submitting User Content, you grant Coded a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content for the purpose of operating and improving the Services, including for training AI models in anonymized and aggregated form.
You are solely responsible for your User Content. You represent and warrant that:
We reserve the right to remove any User Content that violates these Terms, without notice.
Coded uses artificial intelligence to deliver personalized coaching, hints, code reviews, and curriculum recommendations. By using AI features, you acknowledge and agree that:
AI coaching is a learning tool — it's designed to help you think through problems, not to replace critical thinking or independent problem-solving.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Coded does not warrant that any coding skills, certificates, or knowledge gained through the platform will result in employment, promotion, or any specific career outcome.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CODED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR:
IN ALL CASES, CODED'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CODED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if Coded has been advised of the possibility of such damages.
You may delete your account at any time through your account settings. Deletion ends your license to use the Services and triggers data deletion per our Privacy Policy. Active subscription charges will continue through the end of the current billing period.
We reserve the right to suspend or terminate your account, with or without notice, if:
Upon termination, your right to access the Services ceases immediately. Sections that by their nature should survive termination (including IP, disclaimers, liability, and dispute resolution) will continue to apply.
Before filing any formal legal action, you agree to contact us at legal@coded.app and attempt to resolve the dispute informally. We will try to respond within 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), except as stated below. The arbitration will be conducted in English and the seat of arbitration will be in the State of Delaware, United States.
You and Coded each agree to bring claims only in your individual capacities, and not as a plaintiff or class member in any purported class or representative proceeding.
Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Coded regarding the Services and supersede all prior agreements.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
